On May 31, 2013, the U.S. Department of Education, Office of Civil Rights (“OCR”) issued Findings of Fact and Conclusions of Law exonerating MGO client Jefferson County R-VII School District of all charges that it discriminated against a student on the basis of race. The student’s parent filed the Complaint with OCR alleging that the District had discriminated against the student by failing to take prompt and effective action in response to racial harassment of the student by other District students. In finding in the school district’s favor on all allegations in the Complaint, OCR’s findings stated that “the actions of the District in each of the incidents mentioned were reasonably prompt and effective with respect to the specific perpetrators identified as a result of the District’s investigations.”
